LICENSE AGREEMENT ================= IMPORTANT INFORMATION You should carefully read the following Terms and Conditions. Your purchase or use of our products implies that you have read and accepted the License Agreement. LICENSE Our website grants you non-exclusive limited license to use the skins/templates and other products sold through our web site by independent content providers (the "products") in accordance with these Terms and Conditions (the "license") issued by us. USAGE You may use each individual product on a single website only, belonging to either you or your client. You have to purchase the same skin once more in order to make another project with the same design. All imagery, clipart and fonts used in our templates are royalty-free and are the integral part of our products. Limited-usage License gives you the right to use images and fonts only as a part of the website you build using your template. You can use imagery and fonts to develop one project only. Any kind of separate usage or distribution is prohibited. MODIFICATIONS You are authorized to make any necessary modification(s) to our products to fit your purposes. SupportSkins is not responsible for any changes you make to the original skin/service we provide. UNAUTHORIZED USE You may not place any of our products, modified or unmodified on a diskette, CD, website or any other medium and offer them for redistribution or resale of any kind without prior written consent from our company. Your account shall be permanently suspended with possibilities of legal action to recover the damages. You may not sub-license, assign, or transfer this license to anyone else without prior written consent from SupportSkins.com. SUSPENSION OF LICENSE In the event SupportSkins determines that the buyer is in breach of this agreement, SupportSkins may suspend the buyers account temporarily or permanently until the buyer cures the breach of this agreement. OWNERSHIP You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of independent content providers. Our products are provided "as is" without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products. MINORS This website is a business and commercial site. As such, it is not intended for children or minors. COPYRIGHT NOTICE You are entitled to leave the SupportSkins copyright notice along with the link to our website which appears at the bottom of every skin. Any such removal/edition without SupportSkin's consent will be considered as breach of License Agreement. Copyright information for a skin can be removed on purchase of the Branding Free License offered by us. VERIFICATION All received orders are subject to verficiations and are activated within 1 business day. Any order triggered as fraudulent by our system is subject to further verification which can cause delays in activation. In such a case, Client shall be requested to provide further information for order verification. AMENDMENT OF LICENSE AGREEMENT Our company reserves the right to change or modify current Agreement and Refund policy without any prior notice. Any such modification or amendments will be binding to the Client; existing and new. Continued use of our products and service after such posting occurs shall be deemed to be an acceptance of all terms in the amended agreement. It is the responsibilty of the Client to review our website on regular basis for any such amendments. REFUND POLICY Since SupportSkins is offering non-tangible irrevocable goods we do not issue refunds after the product is delivered/emailed, which you are responsible for understanding upon purchasing any article at our site. Please make sure that you understand and know which skin/service you are purchasing before placing the order. However, we realize that exceptional circumstance can take place with regard to the character of the product we supply. Therefore, we DO honor requests for the refund on the following reasons: - Non-delivery of the product: due to some mailing issues you do not receive a delivery e-mail from us; - Irreparable defects or grave difficulties with the product editing: although all the products are thoroughly tested before release, unexpected errors may occur. This reason should be submitted to our Support Team's approval. The deadline for any refund claim is one week after the delivery date. Refunds once approved will be issued within one week subject to approval by the Support Team. PRIVACY POLICY SupportSkins automatically receives and records non-personal information on our server logs from your browser including your IP address, cookie information and the page you requested. However we does not connect this non-personal data to any personal information collected from you. SupportSkins will not disclose your personal information to anyone expect in the following cases - We have your express consent to share the information for a specified purpose; - We need to respond to court orders or such other legal process; - We need to protect the personal safety of the users of our websites or defend the rights or property of SupportSkins; - We find that your actions on our websites violates the Agreement or any of our usage guidelines for specific products or services. Unfortunately, no data transmission over the Internet can be considered 100% secure. However, your Information protected for your privacy and security. We also safeguard your personal information from unauthorized access, through access control procedures, network firewalls and physical security measures. DISCLAIMER SKINS AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. The user must assume the entire risk of using them. ANY LIABILITY OF SUPPORTSKINS WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF PURCHASE PRICE. Except in respect of personal injury or death caused directly by the negligence of SupportSkins.com, in no event will we be liable to you for any damages, including any lost profits, lost savings, loss of data or any indirect, special, incidental or consequential damages arising out of the use of or inability to use such Skins/Services, even if SupportSkins.com has been advised of the possibility of such damages. Nothing in this Agreement limits liability for fraudulent misrepresentation. The icons SupportSkins.com use for its helpdesk are copyrighted work of Arvid Axelsson. We thank him for allowing us to use his work on our portal. These icons are NOT offered for sale.
